How to make claim against the company

Hi my brother met with one accident inside the compay on duty timings,he is working on under contract base as a driver he is 28 years old even the company gave only ESIc facility. here what happend he got grievous injury even left hips was broken on that basis one major operation done another major operation is there next moth.so here he con't walk also .,he con't sit also he is only like baby situation only on bed al things to do ..on this basis what we can do we approach the company for compensation but company told only we give ESIC facility other things we are not responsible like that so what we can do now please give me information as soon as possible
