How to get full and final settlement with the previous employer

28-Jul-2023 (In Labour & Service Law)
I had worked with the IT company more than 1 year. When I resigned from the company with prior notice of 15 days( Although it was not mentioned on the offer letter). At the time of FNF he told me that you have not served 1 month notice period that's why we could not give your Full and final amount. Still they kept hold my FNF. Please suggest me what steps couLd I take to get my FNF. It became more than one Year.

Dear Sir

Thank you for your query. Did any document signed by you at the time of joining mention a 30 day notice period? Did they provide you with any employment manual or HR handbook which would have mentioned this 30 day period? If this period was not mentioned anywhere then they do not have a right to hold back your full and final settlement. They need to pay the amount due to you as long as you have not violated the terms of your employment agreement. I would suggest you consider sending them a legal notice as you have a valid cause of action. We can help you in this and also guide you with respect to the next steps. Please feel to call us or we can schedule a face to face meeting as well.

First send him a legal notice through an Advocate, contented all the facts.
If they still failed to clear your F&F, you have an option to file a Suit for Recovery, where in you can recover your amount.
