How can i take action against appeal in Delhi High Court

07-Nov-2023 (In Labour & Service Law)
Fit for appeal in hon'ble supreme court--- I had filled an writ petition in nov 2013 in the Delhi high Court w.p.(c) 7500/2013. Which was allowed. The department filled an appeal in the division bench LPA no.696/2015. Their appeal is also allowed. If possible can anyone help me know that is there a chance for appeal in the apex court. I would have attached the judgements but there is no option

Letter Patents Appeal (LPA) is an appeal from a decision of a single judge to another bench of the same court. It was a remedy provided when high courts were first created in India by Letters Patent in 18th. The next remedy available to you is to file a Special Leave Petition in the Supreme Court. You may give me full account of your case for further necessary action. Regards

Hi

will glad to help you. Yes you can file an appeal under article 136 of the Constitution of India i.e. Special Leave Petition. That is going to be second appeal so court will strictly decide the matter on question of law.

Considering that your writ petition was allowed by the single judge and order is being reversed in appeal of the department , there seems to be fair chance of slp in supreme court being admitted . Rest can be confirmed only after seeing order and merits of the case as nothing has been stated here.

There is every possibility for filing a SLP before the Hon'ble Supreme Court. Kindly consult a lawyer with all the relevant papers. Then only it's possible to draft a SLP at the earliest. The other thing we need to look into is the delay part in filing the SLP after the LPA allowed by the High Court.

Chances before the court of law always depends upon the merit of your case and not otherwise. If you have gd merit in your case, then only you can succed in your claim, which can be seen and told after seeing your complete file
