My Salary was Rs.42,000 P.M.which I was getting in bank from April '16. On 25th July the owner of the hotel called me on phone & told me to leave the premises immediately with one month salary to be paid in next month of August '16. As a gentleman have left the hotel. After writing mail to various persons for payment including owners got no reply from them. Then on 3rd October '16, I received a mail with a cheque amounted to Rs.13,107/= only. Despite asking them, How they got this figure in lieu of Rs.42,000/= for my Notice period of one month salary. No Offer letter was given to me..I wish to know how can I recover my notice period salary from them. So, I need your advice about the above matter. Thanking you in anticipation of a legal advice.

As per your query:-
1. You don't have your Appointment letter
2. You have worked as GM having salary of 42,000/- per month
3. You have been paid Rs. 13,107/- only in lieu of your one month notice period.

Considering your facts as stated the only legal remedy available with you is to file Civil suit for recovery before the competent court of law wherein, by adducing evidence both documentary and orally you need to proof that you have worked for them and they still need to pay Rs. 42,000/- minus 13,107/- .
