High court Group C exam Women reservation rules

I have two concerns 1). My wife appeared at the High Court groupC recruitment exam conduct by the Allahabad High Court in 2014, just few days ago, they published detailed marks of each candidate apperead, at their website. Total score obtained by my wife was given as 94, however in the same list it was mentioned that cut off for women candidates stands at 75.4. The problem here is my wife was not selected by the court even after scoring more than cut off mentioned by them. Second conern 2) The number of women candidates recruited by the court was 203 out of 2029 total recruits which is clear violation of state govt. women reservation rule, the same rule was mentioned the notification publised by courts, even then they did not follow it. The number of women candidates should have been 407 and in that case my wife would have found a place in the list. I am seeking a legal advice on this.

Before I answer your query, please tell that whether this requirement drive was a two step procedure? As in, after qualifying the written examination, did you wife also faced the interview? Secondly, please clearly spell out as to what did the advertisement said with regards to reservations?

Dear,
You have not given the exact date of declaration of result. However, I can make out clearly that you are eligible for appointment in the High Court for the post for which you have appeared. Therefore, it is hereby advised that you can file the writ before the High Court of judicature at Allahabad at the earliest so that there is no lapse of vacancy due to lapse of time.

You need to prefer a writ petition against the recruitment however your query need more information by your side including the government rule you are talking about as well as the high court rules. Then only your query will be solved.

For better understanding of the procedure your second query is being answered first - Reservation policy of Allahabad High Court, clearly, divides reservation into two categories:

(i) Vertical [Reserved (SC- 21%, ST- 2% and OBC- 27%) and Unreserved (General- 50%), and
(ii) Horizontal (Women- 20%, DFF- 2%, ESM- 5%, Physically challenged- 3% and sportsmen- 1%)

Within the Unreserved 50% seats; there is a sub quota of 20% for women. If the total no. of recruits is 2029, then 50% reservation is for unreserved category which amounts to 1015 recruits. Furthermore, 20% of this unreserved category is sub-reserved for women that would amount to 203 recruits. Therefore, there is nothing wrong with the calculations made by the Allahabad High Court regarding this recruitment.
Therefore the number of women candidates recruited by the court is correct.

As far as your first query is concerned I would like to inform that the normal process of selecting a judicial candidate involves prelims, main examination followed by an interview. Thereby, your wife's interview could be a reason for her non selection.
