Gratuity and relieving letter due from my previous company

12-May-2023 (In Labour & Service Law)
I am suffering with cervical spondylosis since 3 years. As I could not continue because of health issues, I have resigned in Nov'15 (Served 7 years in the MNC) without serving the notice period of 2 months, Management did not give me LOP and neither considered my health. I raised an internal complaint to the senior leadership and there was no resolution. Now, in May when I am requesting the Gratuity and Relieving letter to do Job for living, Management is asking me to pay back the 2 months salary. It took 5 months and they did not settle the issue. ID card is still with me. Please suggest.

To get your experience letter you are required to send a legal notice to the company demanding the same.

Failure to provide you the same, a suit for declaration is to be filed in the concerned civil court.
