GOVERNMENT EMPLOYEE RETIREMENT BENEFITS QUERY

08-May-2023 (In Labour & Service Law)
Hello.. I would like to know about the general rules of a retired government employee... The person has worked as an executive engineer last in Tamilnadu Electricity Board before he retired last year in June.. He has a wife aged 51, an unmarried daughter aged 28 and a son aged 24.. The person is not with the family and is living somewhere now by simply sending 18,000 per month to the family.. I would like to know if is this applicable as per government rules and regulations as not making any of the money he received as retirement benefits to not reach his family?

There is no such rule for the same as all the post retirement benefits are the property of the said employee himself, he decides to whom it goes. Although, your mother can file a suit maintenance under section 125 of CrPC. Also, if the said employee has nominated any of the person in the family for getting the said retirement benefits then he/she can claim it only after the death of the said employee.
