Extension of probation without evaluation. Can I claim my perm. employ

My employment start date was 01-04-2016 as manager technical. On 10-01-2017 I was handed a probation extension letter dated 29-12-2016 citing my performance not up to the mark, although my performance evaluation was not done. According to law I understand that after completion of 240 days of continuous employment an employee automatically becomes permanent. I have already completed 240 days before the issue of probation extension letter. Kindly advice whether I can claim my permanent employment status?

First of all, as you have not stated all the facts regarding your employment as whether your are working in a govt. organisation or a private company.
Refer to the rules and regulations of employment of the organization you are working under.
Go through the clauses of your own employment letter provided to you.
In case of Government Organisation File a RTI.
In case of a private organisation, talk and consult to your HR.
