Employer refusing to return original documents

I have attended an interview and got selected but before issuing offer letter they ask me to submit original marksheets for security purpose. I have submitted the docs and collected offer letter but due to unavoidable issues i could not join as agreed. I have intomated the same within two days after collecting offer letter but the company is asking me to pay one month ctc. Its companies policy it seems. How should i proceed further to get my docs back?

However no company has right to keep the original marksheet of the candidates as it deprives you of your fundamental rights. But still we will have to examine the policy
