21-Mar-2023 (In Labour & Service Law)
I work as I recruiter for 2 years in consultancy. My official notice period is 45 days. I am ready to serve but my employer is not releasing me for below 50% performance. He wrote in offer letter the salary as 20,200 bt he gave me 12000 per month and now 14000.I am well from last 4 months so want to leave.

Write an email to your employer stating that as per the terms and conditions of employment you have served to the best of your ability and it would be unfair to relieve you at 50% performance and would further minimise your future prospects of work. Since it is a private company nothing much can be done to compel the employer with respect to your grievance. However, since he has not paid you as per the terms of the offer letter, you can file a suit for recovery against the company asking for your dues considering 20,200 as your salary for last two years.

Please take note of following -
1. You need to send them a legal notice asking for your Full and Final settlement and for your reliving as per the employment agreement which you have with yourself and your organization.
2. If they fails to respond to the notice or do not give any proper response thereto then you can drag them before the competent court of jurisdiction.
