Employee influencing other employee's to leave company

23-Dec-2023 (In Labour & Service Law)
Sir, we had an employee in our office who worked with us for a year. All of a sudden, last month he just left and never returned to work. After numerous phone calls, trying to contact him, we found that he has left to his town. In the meantime, he also convinced other employees from our office to join other companies wherein he takes a commission for each person he provides. This has been happening for quite sometime, and he has managed to sway 2 other employees from our factory. Is there any action that can be taken against him? My employees can also say this in court.

To initiate action against the employee, the appointment terms, Non-disclosure agreement, Employment Agreement signed by him while joining your organisation need to be studied. If there is a clause regarding non-poaching, non-competition exists in such documents, you can very well initiate civil/criminal proceedings against him.
