Does my company fall under the provisions of Payment of Gratuity Act ?

Dear Sir/Madam, I have worked in Japaneses company for more than 5 years, they have a project office, and Branch Office in delhi. below is the brief of both the offices 1. Functional Integrity, and Seprate Legal Entity (Project Office and Branch office is different) 2. Distinguish Finance and Accounting (Maintaining Seprate accounts) 3. No interaction between Employees of Project O & Branch Office 4. Total Employees less than 10 in DPO. But Branch Office, and Project office consolidated total strength of employee is more than 20, and All the Income Tax, Company Law, and PF compliance are done together. I would like to know, whether i am eligible for gratuity or not?

If all the compliances are being done together for the entire set up of the company wherein the muster roll shows all the employees of the same entity or the salary slip carries the same name of the company for the both units then your company definitely falls under gratuity act and it has to comply with the norms of payment of gratuity act.
