Do we need to wait for 3 months to get salary in maternity cases?

My wife is working in a Private company and went on Maternity Leaves. She delivered a baby in a private hospital and come under ESIC. Her office people are not giving her salary in her maternity and asking to fill various forms and contact ESIC. We have filled Form 23 in ESCI local dispensary and being asked to wait for 3 month for further documentation. Her maternity leaves are approved for 84 days till October 17, 2016. Do we need to wait for 3 months to get salary in maternity cases? She will receive salary from ESIC or from her office where she works?

Since your wife is covered under the ESIC scheme, she will be paid the salary in lieu of the maternity period by ESI. You are mandated to duly fill the Form 21 and 23 and submit it along with the relevant documents. She will definitely get her salary for 84 days/3 months from ESIC once proper documentation is done. The Pvt. Company is not liable to pay.
