Here is brief description of our issues. BHEL has three cadres namely Executive (BE,MBA), Supervisor (Diploma, BBA, BCA) and Artisan ( ITI). Since inception of BHEL we maintain relativity among entry level pay scales of 3 cadres, to be precise: workmen to supervisor’s pay scale -66% gap, supervisor to executive’s pay scale-40%, which was disturbed in favour Of 2 cadres namely Executive and Artisan at the cost of Supervisors. In year 2007 relativity of workmen to supervisor- 6% gap, supervisor to executive- 102%gap. We wish to take up this matter Supreme court, how we can proceed ?

Based on the facts mentioned by you, it completely appears to be a case of arbitrary action taken by the management to favour certain specified individuals at the cost of the others. You can of course challenge this as a violation of the fundamental rights guaranteed under the Constitution of India - specifically Article 14. I suggest you should consider approaching the High Court first before going to the Supreme Court. Both can provide the same remedy and going to the High Court first will allow you to keep open the opportunity to go to the Supreme Court at a later date. We specialise in handling matters at both High Court and Supreme Court levels and will be happy to take up your case on a very reasonable basis. In fact we have prior experience dealing with BHEL matters.
