11-Sep-2023 (In Labour & Service Law)

I joined a software firm and worked only for 1 week, during that time i was a bench resource not assigned to any project work. I faced lot of mental harrasment from the company so i left the job, i didnt serve any notice period, i just sent email from home stating that i am planning for next job opportunities. Now the company stating that we will take legal action and asking me to pay 2 month salary. i stayed in the company for 1 week as a bench resource, i faced lot of harrasment from them. Can you please advice me how to go ahead

We will have to examine your appointment letter. If as per the appointment letter you are required to serve 2 months notice then you cannot resign or stop going to your work without serving notice period.

If you were harassed at workplace, then you should have informed HR and brought these facts on record and then resign.

We suggest resolve the matter amicably.

If the Company asking you to pay 2 month salary means there must be a specific term in your Appointment Letter regarding the Notice period for resignation , on the basis of which they are claiming the same. Kindly Check your Offer/appointment letter. If the specific condition is there in it you need to pay them.

I think you might have singed some confidential agreement or an indemnity agreement with your company and based on which they have communicated to you that they will take a legal action on the same. I suggest you to comply with the terms of the agreement if it is well within reasonable condition.
