Consequences of breaking the bond of the company

31-Jul-2023 (In Labour & Service Law)
Recently I joined an IT firm and signed a three year legal bond worth 3 lacs. The firm sent me onsite at location where I am not comfortable. Now I want to return and company wants me to stay. So I want to return for that I have to break the bond and leave the company. I don't need anything from company like reliving letter or experience letter from company. Now what will be the consequence if I break the bond? Do I have to pay the amount? and what if I don't pay the amount?

Yes, he has all the rights to sue you. As you have violated the terms of agreement so he can file the case in the civil procedure code as well as contract act can also be invoked here. As per the recent development in law made by the Supreme Court and various High Courts, such bonds are lopsided and are not legal and enforceable under law.

You can send a legal notice to the company for asking for your dues.

If the company takes any legal action against you to ask for the bond amount, you must contest it in the court of law as the enforcement of these employment bonds is not maintainable under law.
