Company take cheque to threaten employee if they leave co. in between

11-Feb-2023 (In Labour & Service Law)

This pertains to a financial services co that hires from bschools regularly. Makes students sign 3 yr offer letter on stamp paper and collects a cheque of huge amt(equal to their annual salary) every 3m from them. They promise certain pay hikes annually as per contract but fail to pay it/delay it. If employee gets frustrated and leaves, they bank they cheque and threaten them under sec138 and also pursue them under civil case for breach of contract. What is the remedy? Are such one sided contracts valid in court of law?

As per the Indian constitution no person can bind anyone. If the company is blackmailing, then you can resign from the company and challenge the same under Article 32 i.e infringement of fundamental rights.
