Company not settling the final payment and asking more money. Advise

08-Feb-2023 (In Labour & Service Law)
I have been hired by a company in Sept 2016. I resigned in Jan 2017. I have served the notice period even. My full & final amount was around 42000 out of that they have deducted income tax of 31,500. The left out amount was to be paid to me but now instead f paying my pending amount they are asking to repay the relocation paid during my employment. But repayment of this amount was never communicated to me neither in writing nor verbal. Now they have relieved me from my duties. What should I do now? Can I complaint against this in Labour dept?

Firstly, you should send them legal notice through advocate. If your employer is private limited company then there are also other few ways to lawfully intimidate them. Usually, most matters get solved due to notice. In exceptional case if they still do not make payment then you can file a case in labour court and they will be in quite some trouble.

If there is no condition in your appointment letter they cannot deduct any amount beyond the condition laid down in the appointment letter. Further should file application about release of amount due to you. you should ask your company why they have hold the amount which is not mentioned under the Terms and condition of the appointment letter. In that latter in the last you should also write in case if the amount will not be released in your favour you have no option but to file case against the company in the labour court.
