02-Nov-2023 (In Labour & Service Law)
I am working in a MNC co. currently on which role I am working is going to some other person due to cost cutting now company is giving me night shifts role but I ask please provide me day shifts because I am working on this shift from last two years. Due to medical issue I can't work in nights. If I denied to work on night then can company quit me? Is any remedy available to me so that we can file a case.

You have not mentioned the position on which you were appointed nor have described the nature of duties you used to perform
All the above are required to be seen first for a proper advice
However please note the services of an employee on a less favourable term to another company without the consent of the employee can not be made. For a crucial examination the manpower strength of the Company & licenced capacity of the company & natuer of business is also required

Hi,

In such situation the terms and condition of the contract between you and company is to be seen and thereafter only one can guide in proper way. One more suggestion write a letter to higher authority and try to explain your health problem.
