Company asking to pay bond amount and threatening me for legal action

12-Sep-2023 (In Labour & Service Law)
Dear All, One of the Ltd Company had given me offer letter stating “As mutually agreed you will abide by two years bond from the date of appointment …….if you leave the service before two years then you would be liable to pay two months total salary which would be over and above notice period terms.” I Same way it is written in appointment letter. I have singed on both the documents (both offer letter and appointment letter on company letter head) , there is no document or bond I have signed on legal stamp paper. I worked for that company 9 months. And left the company without notice period due work assigned was not as per my profile. Now company is sending notice on letter head to pay bond + notice period amount and threatening me for legal action. Company has not invested anything in terms or travel or training which they can claim as an investment on me. Wanted to Know is company can take legal action to recovery money? Should I ignore the notice or hire a lawyer to reply?

Hi

will glad to help you. Company can not put such kind of unreasonable terms in appointment letter . Notice send by the company is illegal subject to the condition that you served your notice period.

Please take note of the following -
1. Since you have received the legal notice from your past organization you need to reply back to the same by hiring an advocate for yourself.
2. There are two ways of resignation one by way of serving the notice period or one by way of buying that notice that period. In second option you left your last month salary without making any claim thereto.
3. A bond is valid only if you have received any training for working in that organization or domain or field else not.
4. They will come up with a case against you and you should be prepared for that.
