can gratuity be claimed before completion of 5 years

I will complete 4 year and 10 months in current company (19.12.2011 to 14.10.2016) and company is refusing to pay my gratuity which is part of CTC. Company is working for 5 days in week since 2011. pls guide for elegibility
According to payment of Gratuity Act, 1972 & Rules, an employee is eligible for getting gratuity after the completion of five years in an organization. On the other hands, if a worker have worked for 240 days a year is complete. It is not the matter of six working days in a week or 5 working days in a week.
