Can court hear accused to send summons in summary cases?

IN summary cases under C.R.P.C.,can court hear accused to decide whether summons should be issued or not.This is related to case under Sec. 48 (1) of M.R.T.U. and P.U.L.P. Act 1971,before Labour Court.

Hello,
Usually in summary suits the court calls the complainant to prove the case on merits and and on facts, as after investigation there was nothing concrete found against the accused. Summons is sent so that concern person remains present in the court.
