Breaking of Bond before time with a company.

19-Sep-2023 (In Labour & Service Law)

I am working for L&T Construction and I was made to sign a bond of 2 years duration at the time of my joining; breaking of which will result in a penalty of 2 lakh rupees. Its been 1 year and 4 months now and the working conditions are very harsh. Also the company hired me as a trainee and after 1 year it was supposed to give my confirmation. Its been four months past that and I have still not received it. Also the company is firing employees all around right now. I therefore want to leave the company as currently I have a better option. But if I leave right now; will I have to pay the bond am

I hope that the condition of giving you promotion is a part of the service contact. If not then the same is hopefully in black and white. If the employer is breaching the conditions of contact of employment then you are entitled leave the job. Moreover as you say that their are instances of harassment then you must also quote them in the notice that you should give intimating the employer that you intend to leave the service. You cannot be fastened with the liability to pay the bond amount.

Hello,
Firstly the company is not legally allowed to execute the bond signed by you. Secondly if the working conditions in the company is not appropriate with your health conditions, you can initiate a legal notice to that effect and resign from the current employment.

You need to check the exact terms of your bond and see if there are any conditions under which the penalty amount can be waived.
Further, speak to the HR and check whether the organization has an policy for reducing the bond period or waiver of penalty amount.
