Bond for working 3 years I resigned not returning my certificates

09-Feb-2023 (In Labour & Service Law)

Hello, I have joined in a manufacturing company for a job with 3 years bond and all my certificates. and the bond terms are like if we leave the company before 3 years we have to pay 1.5 lakhs. but due to health issues i kept my resignation after working for 1.5 years in the company. so, i asked to return my certificates but they are asking me to pay the money of 1.5L as per the bond terms to release my certificates. So, please suggest me how to proceed further to get my certificates with out paying money. Thanks in advance.

Yes you will be required to abide by the terms of your employment contract. You may however challenge them on certain grounds if the provisions are unreasonable. If you refuse to serve the notice period and repay the bond then the company may proceed against you. This is when you will need to challenge the contract. The company cannot impose a penalty on you if they have actually not expended that amount in your training etc. The company will need to prove this before the court. Feel free to get in touch if we could be of any further assistance to you.
