I OPTED FOR VRS FM HI8NDUSTAN CABLED LTD W.E.F 31.3.1997. EX GRATIA & GRATUITY WAS PAID IN UN REVISED SCALE THOUGH IT WAS DECLARED IN WRITING THAT REVISED PAY SCALE (5TH PAY COMMISSION) MAY BE DRAWN FROM MONTH OF JAN 97 PAYABLE IN FEB 97. AFTER REPEATED COMMUNICATION HCL REFERRED TO SUPREME COURT RULINGS TRANSFER PETITION(CIVIL) 8 OF 2000(A.K.BINDAL & ANR(PRT) VS U8NION OF INDIA. THOUGH THEY ISSUED INTERIM ORDER LONG BACK TO PAY ARREARS GRATUITY ARISING OUT OF REVISED SCALE NOW DENYING PAYMENT WHEN PAYMENT WITH BANK INTEREST SOUGHT. I WANT TO KNOW IF THESE 2 CASE HAS LEGAL MERIT TO CLAIM ARREARS WITH COMPENSATION. CAN I SEEK PUNISHMENT OF THOSE RESPONSIBLE FOR SUCH HARASSMENT
MY OPINION THAT I have read you matter and i think that according to statute you have every scope to challenge at the proper forum, and you have scope to get the perfect order at competent forum, you should move at Calcutta High court without any delay you have merit, you contact with me without delay.
