Am I eligible for gratuity or not after working for 4 years

I've worked in automobile co. For 4yrs and 10 months, they didn't my full n final as yet.. From 2011, I m eligible for gratuity or not? Pls answer madam as the earlies
Yes you are eligible for gratuity. Issue a legal notice first demanding both. In the legal notice provide a stipulated time to return the money failing to do so, you would require to file a civil suit for recovery in the concerned civil court. Please note that you will have to pay the corresponding court fee as per the amount of recovery to file the recovery suit. In case of gratuity you can file claim before the Controlling Authority under the Payment of Gratuity Act within the area, your employer’s establishment is situated or where you were working at the time of termination.
