Insurance company is not ready to insure me what to do.

i bought an iphone5s from laxmi nagar along with phone insurance. my phone was stolen on 05th dec'16.i intimated the insurance third party but they are saying that i cannot claim the insurance because the sim whith which the phone was stolen is not not in my own name. this was not mentioned in the terms & conditions which i read & have with me but the third party is not even forwarding my claim to the insurance company saying they will reject it. i have insured my phone not my sim, how does it matter that whose sim was there in the phone, as i am free to buy the phone for anyone & he can use whoever sim he wants. they are torturing me & not taking me seriously & also asked me that nothing can be done. the claim amount is 21799.please help me.
