Insurance company denying on grounds of no complaint within 24 hours

I have insured by mobile worth 25k , i lost within a year. While travelling i have lost my mobile , i can't able to complaint at that time since it is night . I have complained in police station by 1 day later. When i applied for the claim , they rejected my claim because i haven't complained within 24 hours which was not intimated by me before making insurance.What should i do now.

You have not mentioned the basis question that when you have intimated to the insurance company regarding loss. If you have reasonable explanation regarding delay in intimation than you can get the insured amount. Because in the insurance contract its a fundamental duty of insured that he should be immediately informed about the losses to the insurer for the purpose of possibility to recoverd the loss items.

Send them legal notice, explaining- how long the delay was and the reason for such delay. If they are answering to your satisfaction then fine. If not, Just file a complaint in Consumer Court taking the ground of unfair practice and deficiency in services.
