Claim for insurance rejected due to online FIR without signature
07-Mar-2023 (In Insurance Law)
My Samsung J2 phone theft due to pickpocket ina a bus. I lodged an Online FIR after that IO came to me and taken statement of lost phone in written and went back. Now I claimed insurance from Appsdaily but he denied and asking about there is not any signature or stamp of Police. My Question is that is there any need of sign or stamp if FIR is lodged at online FIR is registered u/s cpc 154 IPC 379 Can't I get my insurance claim?
Yes you can get the insurance as you have the receipt and copy of the said FIR. Ask your insurer to provide the damages and if he denies then you can send him a legal notice demanding the same, if the insurer still denies then, It being an insurance company you should approach Insurance Regulatory Development Authority (IRDA) and thereafter you may approach court. You may also directly refer the matter directly to consumer courts with your grievances. Which court shall have the jurisdiction may only be informed after knowing your matter in detail. We may assist you if you so desire.
