We have done remarriage and now we want to migrate to abroad

I have done remarriage with a girl who had taken divorce on stamp paper with her ex husband. Now we want to move to abroad, when i tried to apply for her visa based on dependent, i came to know that as she had not taken legal divorce, she will not be consider as my legal wife. One lawyer had suggested her to apply for legal divorce with first husband and then we need to do remarriage post that only our marriage will be consider as legal. Could you provide me guidance on the same, how we can move and what is the present status of my marriage.
