Q: Used a forged OBC certificate to get job in central government.

I applied for a job and got selected. But i used a forged OBC certificate. I have all the proofs to prove it that it is true. What all legal consequences can i face?

Harpal Singh answered
If at any stage the forgery is detected that may entail removal from services and imposing penal charges of forging documents and using them , against you. The offenses are non compound able and non bailable.

Q: Police not doing their job properly. What should i do about it?

I have a private limited company. One person did business with us and later on closed office and ran away. We tried searching him but couldn't find him. We did FIR. The police is not able to investigate the matter. What can i do about it?

Pls remember one thing that FIR doesn't mean that matter will be unearthed always. At times police don't have any clue so as to proceed in a particular direction. It may result in police filing a closure report . Or if accused is not traceable then file may be closed after getting fin declared P. O. But if you feel that police is deliberately not performing its duties you may approach the concerned court with an application u/s 156(3)Cr.P.C with a request to monitor the investigations. You may tell the court on what points investigations is not being carried out . Then court may issue necessary directions that the police has to follow.

Q: Fraud 304B case filed on my brother. What to do?

sir, mera bhaiya ek fozy hain or unka sadi huwa unki wife mere ghar 2 din rahi or apne mayke chali gayi 4 month baad usne wahi sucide kr li kerosene oil se or 99% burn injury,, or 5 month aproximate child posmortm report me aaya hai jabki sadi huwe uske 4 month 12 din huwa tha mere bhaiya duty par the uski mumy cropt hai mere baiye ko bhut tourture kia sab apni hi beti ko murder krke police se milkr dahej pratarna ka case kar diya .... un logo ne mere or mere fammily walo pr 304b ka case kr diye hai sir. What to do?

If case is false then investigations must unearth it. Allegations in the complaint must be substantiated by evidence for case to stand the scrutiny of courts. If there is no evidence against your brother then case will not stand. Though it is advisable to move the court of competent jurisdiction for anticipatory bail.

Q: Arrested for kidnapping after returning the child home. What to do now

One of my relative has been arrested and is in jail since saturday. He kidnapped an 11 years old child and asked for ransom, but after a while he returned the child to his house safely. Chargesheet has not been filed, i want to know what should be our next step? What can we do in such a situation?

Harpal Singh answered
Engage an advocate and apply for bail. If you get bail then wait for chargesheet that may take few months.After getting a copy of chargesheet try to build up a defence that can disprove the case of prosecution.

Q: Daughter killed in australia and husband committed suicide. What to do

My daughter was married in india, thereafter she moved with her husband. There as per my knowledge she was killed by her husband and her husband committed suicide later on. The family started asking for dowry 3 later of marriage. Now i want to hold in laws liable for the death of my daughter. What should i do?

Harpal Singh answered
You can file a complaint with the police stating the facts and evidences with reasons why you feel that her in laws are also liable. If they find merits in your complaint, FIR may b registered and investigated . You may also approach court for the same if police fails to act. Ultimately court will decide if your complaint has any merits and will act accordingly.
