12-Jul-2023 (In Family Law)
My wife has deserted the matrimonial home 9 months back and she alleges that I would stay in my parents home If you call me then I would put false case like you take drugs Can I do any drugs test to prove that I dont take any drugs any blood test or urine test will it be helpful and it shows that I have not taken drugs since last few years?(1yr or 2yr or 3yr)? Will it be helpful in court if she files a case with such false complain if I show my blood report?

If she files any false case against you then at that time you may contend in court or request the court to go for a test as the part of investigation. If you want a divorce.
There are two ways to take Divorce in India:
Divorce with Mutual Consent: When husband and wife both agree to a divorce; the courts will consider a divorce with mutual consent. For the petition to be accepted, however, the couple should be separated for over a year or two years (as per the relevant act) and be able to prove that they have not been able to live together. Often, even when either husband or wife is reluctant, they still agree to such a divorce because it is relatively inexpensive and not as traumatic as a contested divorce. Matters such as children’s custody, maintenance and property rights could be agreed to mutually.
Divorce Without Mutual Consent: In case of a contested divorce, there are specific grounds on which the petition can be made. It isn’t as if a husband or wife can simply ask for a divorce without stating a reason. The reasons for divorce are as follows, though some are not applicable to all religions.
1. Cruelty
2. Adultery
3. Desertion
4. Conversion
5. Mental Disorder
6. Communicable Disease
7. Renunciation of the World
8. Presumption of Death

do you intend to take a divorce? if yes then settle it amicably and get out of the trouble.

answering your question definitely you can do the test and yes in future if she files a case against you it will be useful as the piece of evidence. but i would suggest that incase she files a case and alleges you of drugs then you may undergo the test.

blood report is a useful piece of evidence
