Wife refusing to co-habit with me what to do

26-Mar-2023 (In Family Law)
Respected Members My has a habbit of running away to her maternal home and tooks our child away with her. Last time she came back after 2.5 months. This time too on a very petty argument she was trying to take away child with her but I called police .Policemen after a agreement said that let her go for few days on her on will and she will come back after few days when things would be good. They asked my wife and me to sign a register entry and after that I allowed her to Go. There after I am visiting my child at her place but no one talks to me. My wife today messaged me that she would now leave the city and would take child with her. Please suggest what legal remedy do I have. What actions can I take.

Dear Client,

For the purpose please tell me about the age of your child and where are you residing. What are your income and your wife's. Income. You have the remedy for custody and even you can file a complaint through court. Feel free to contact me.

Firstly make it clear what I want if u want to live with your wife than u can file petition for restitution of conjugal right and custody of your child and if not than u can file petition for divorce or judicial separation under Hindu law.

Hello dear, I hope i will reply you the best with you query.
Legally neither your wife can not leave your home nor she can take away your childrens . The best you can do is file a petition of restitution of conjugal right and compel your wife to stay with you .

Pl do send a legal notice to come to her matrimonial home otherwise you shall be constrained to file a case before a competent court for a suitable direction to her for not violating your legal right to meet your children being the father of your children
