Wife left home how can I call her back to matrimonial home

05-Jul-2023 (In Family Law)
We are happily married family with a 3 years girl child staying with our parents. As both of us working my parents are taking care of the child, even the child is attached to them. Presently, I am in between the job and could not accept offers from out of Mumbai since my wife at least for next 3 years she did not want to go out of Mumbai. Since I am supporting my parents financially, all of a sudden my wife in my absence walked out of house with bag and baggage along with child, without any valid reason, to her parents place and refuses to yield for my request to come back. Kindly advise

1. Lodge a police compliant immediately (you will need it at the later stage once you file a case against her). Police will only give her a verbal request to come back. Should you not file a police compliant, it will prejudice against you during the time of litigation.
2. Send a legal notice which must contain:-
a. the facts in brief.
b. a request to return back to the matrimonial house.
c. to undergo a mediation and thus.
d. an ultimatum failing which you shall be constrained to file a legal proceedings against her.
3. File a petition in family court for restitution for conjugal rights and custody.
