Wife keeping me away from my child, doesn't want divorce, what to do

My wife parents are separating my child from me & threatening me saying I'm black mailing their daughter... I'm being married for 21months & have a 9months old kid. My wife stayed with me only for 4months with me. Each time their parents are preaching to separate me from my mother. Separating my son from me since 6months & they say now her daughter will go to job & take care of child. Our elders had twice settled the issues with us. She is not willing to come to family counseling nor interested for divorce. All this is happening becoz of her parents forcing me to buy a property in their native. Her parents are too much interfering in my personal life incl my salary expenses for mom medical bills. Please let me know how to proceed. Even if i approach Family Court with restitution of conjugal rights what if she does not want to come with me? can i file FIR on her parents please show me a way to get my son along with wife. If not wife i miss my son... atleast my son i need with me.

Since you are willing to continue the marriage with your wife, the only option left to you is to approach the family court with a prayer for restitution of conjugal rights. Let the case be referred to mediation after her appearance.
Hope a good counselling will settle the issue.

You can file for the restitution of conjugal rights and visitation rights to see your kid. If she does not want to come with you, the court cannot compel her to go to your house.

As you told you can file the case for restitution for conjugal right. I hope it is the best way to settle the matter. Here you cant file the FIR against their parents since your wife is with her parents.

In case if you want to continue in the family bond, you are liberty to file the petition seeking restitution of conjugal right. By this you can explain the court that their parents were resisting her to come to you. I hope it is better way.

Hi, first file a case for restitution of conjugal rights and then seek justice. No body can give you a guarantee. We can't tell you wat ur wife will file. Hence consultant a Lawyer and proceed accordingly.
