Dear Client,
You need not worry, You must take experienced legal support. Even death statement shows that your relationship with another lady will not cause punishment. Prosecution, i.e., Police Authorities must prove the death statement beyond any probable doubt to the court that you committed offence. I can say one thing, whether you committed an offence or not is to be decided by the court. For example if some body writes against you and committed suicide and died, that itself amounts to offence, I don`t think so. For filing case and awarding punishment there a is lot be done like proceeding with trial of the case. You need not worry. Filing a false case is not committing an offence and awarding punishment. You must project your case and come out of case and punishment by taking expert legal support by engaging an expert advocate who deals similar cases.

Hello,

Please elaborate under which section(s) your in-laws booked case against you? Without perusing the contents of the FIR, it is difficult to advise. Feel free to share with me the details of the case to get proper advice.

Hi
We need to see the FIR COPY and also the charge sheet.
In general in a dying declaration, the wife should allege cruelty.
Relationship with another lady does not amount to cruelty.
Please refer to supreme court judgment in CRIMINAL APPELLATE JURISDICTION, CRIMINAL APPEAL NO(S).1138-1139 OF 2016 (@ S.L.P. (Crl) Nos. 5928-5929 OF 2016), K.V. Prakash Babu … Appellant VERSUS State of Karnataka … Respondent
The above judgment can be used for citation.
