Who has refused to give the share, as you have not mentioned the same in your query. Your mother has a right to claim a share in your father's assets and properties and infact the same cannot be refused.

If u r only child of ur father then legally only u and ur mother will get all property money of ur father share if someone is denying then he must be trying to cheat u. U should further contact with full details & send them a legal Notice & start legal proceeding as soon as possible. Definately u will get all share of ur father.

First make it clear who they are not ready to give the share the total property of your father is your and your mother because your father as you told died in the year 2008 on 18th September. Where such property is?
