What is the procedure to file complaint against Husband and In-laws

I am writing this in behalf of my Sister who was mentally tortured by her in-laws and her husband living in dubai regarding a few little family issues. She can't take care her 2 little children who are a 6 month and another a 1.5 year old after a fight with her in-laws. I longed a complaint against the realtives of my sister's in-laws and the in-laws too regarding a fight. Its been 2 month but her husband is misbehaving continuously and and asking us to take the complaint back and is organizing a sorry note which will be signed by my sister and other 2 witnesses that she will not do anything bad again and if she did he will divorce. This was against my sister's will, so she objected and asked to put her conditions too for that condition. Upon this her husband is filling a divorce. My request is that we need guide to file complaint against him and her in-laws as she was mentally tortured many time and her husband never talked or listened to her points.

There are strict laws under the Indian Penal Code against cruelty towards a married woman. The provisions of the Indian Penal Code that deals with harassment of a woman by her in-laws is stated under sections 498-A and 509.

Section 498-A: This section deals with cruelty, either physical or mental, against a woman by her husband or any of the relatives of the husband. The offense under this section is punishable with a term which may extend up to 3 years of imprisonment along with fine. The offence under this section is non-bailable and non-compoundable (a compromise cannot be entered into between the parties).

Section 509: This section punishes an act of a person intended to insult the modesty of a woman using any phrases, words, act, or gesture. The section punishes such an act with simple imprisonment of 3 years. The offence under this section is bailable, compoundable (a compromise can be entered into between the parties) and cognizable (an arrest can be made without a warrant).

In case the issue involves an act of domestic violence, a complaint under the Protection of Women from Domestic Violence Act can also be filed. Section 17 of the act provides women the right to her matrimonial home if the in-laws are refusing the same. Further, section 18 of the act can be used to prohibit the accused from doing certain things if the woman was subjected to domestic violence and the possibility of its reoccurrence still exist.

Here your sister was subjected to mental torture in the hands of her in-laws and husband. They were even demanding your sister to withdraw the complaint by organizing a sorry note in which they wanted to throw the mud on your sister as if it was her fault. I suggest you to file a complaint against your sister husband and in-laws and subsequenlty file a Domestic Violence case and a maintenance case before the concerned courts. If you are in a position to engage a lawyer then engage or else approach the concerned district legal services authority and file a petition over there describing your grievance.

Where is your sister now. If she is with her husband and in laws she must come out from that place and file complaints against husband and in laws. She must engage an expert advocate for filing cases against them. She can file criminal cases against her husband and in laws. She must file a private complaint before magistrate against her husband and in laws in criminal courts where she lives.

You can file a police complaint on behalf of your sister in the police station nearest you and then forward the copy of FIR to indian embassy in dubai.
Indian embassy in dubai will make arrangements for getting your sister and children back to india and also will take help of dubai police to get your brother in law to india to attend the police case here.
