what is the procedure of restitution of conjugal rights
15-Aug-2023 (In Family Law)
I got married 3 years ago. My wife was working at a small clinical lab in Hyd, and she hails from a remote village. We had a physical relationship for sometime before marriage and later found that she was into multiple relationships before we met. Even after this, on Human grounds I married her by not abusing and disrespecting her. And let her experience all the pleasures that she never saw. Have loved her like I love myself, I was rejected by my family to get into this marriage, I have rebuilt all my house/family to be like my Dad. now the simple issue that we have is that she keeps denying of what I say and wait till I get angry. and make me abuse her. based on this she left home 3 months ago. and when asked to return home, she is asking for apology from me and all my family. I work in a small call center and hardly could afford the high price of attorneys(Apology). I have no issues to accept her if she returns, I did somehow consult a lawyer and was advised to file RCR,
Marriage is a union of 2 hearts. Success of married life depends on the edifice built with the mutual trust, understanding, love affection service and self sacrifice
Understood the canons of Hinduism theory in conjugal life: the three great aims of human-life which are Dharma, Artha, and Kama, and their connection to conjugal life. Dharma (righteousness) is to do certain things and not do other things- ‘Take out the negative words from your life’. Artha (prosperity) is the protection of what is required and the increase of what is protected. And Kama (passion) is the Desire itself, necessary for the existence of the body. The combination of this harmony creates happiness. The point is, any action in one of them should be followed by the practices of the other two. For a peaceful married life there should always be harmony in marital life

My friend please understand that as your son is 5 months old therefore I believe any legal interference will make the situation more pathetic rather stable. Please appreciate in finding the real problem areas and if possible seek any marriage counselor's help.
From the legal point of view, you may manage to get the decree for conjugal rights against your wife but again she is not obliged to honor the award as it is her fundamental right where she should live!

You can file a petition before the Family court where you reside, for the restitution of conjugal right. I think your problem can be solved through the couselling which will be conducted by the family court.
if she is unwilling to live with your family as per a Apex court judgement it is a valid ground for divorce and first make write to you over whatsapp that she does not want to stay with your family and wants to stay separate, then you can pressurise her by saying about the judgement for which she will fear. after getting it written by her take a screen shot
