What is the extent of liabilities on husband in muslim talaq

# I am 58+ (husband) /a Sunni Muslim / A govt Gazetted officer # My spouse is 55+ ( wife) "". "" Msc / House wife - have a daughter 27 yrs old/ clinical counsellor/unmarried - have a Son 24 yrs old B?Tech Mech. / Unmarried / part time job - living in rented 3 rooms flat ( 20,000 pm) - Marriage solmanised under Islaamic laws in 1988(28 yrs now) - On issue of daughter's marriage decisions a controversy of opinions and heated conversations happened /no injury/ a police complaint only/ - my wife filed a case in Mihila court Rohini MMcourt in July 2014 two yrs bck. - interim maintenance of 21500pm ( 50% of my net salary without considering my liabilities like Home loan and rent payment and tuition fee of my son.) After 2 and half yrs my salary was attached for rocovery of due amount. - despite of repeated efforts and mediation I am unable to motivate my spouse to settle amicably and seems unlikely to settle amicably. SUGGEST TALAAQ AND LIABILITY

See if you have been ordered by court to pay the said amount then the resort available is to move a revision against the order or an appeal in the high Court. If you need to make the settlement and divorce settle amicably then you have to bring the command of the litigation in your hands and stop succumbing to the multiple cases registered. You need to focus on the actual facts by making your Advocate aware of the situations and helping him defend you better. If you need any advice to consult.

It appears that your maintenance case is going on.You wife is yet to file case under Domestic Violence act.The interim maintenance was fixed by you consent.I think no finding to the effect that why 21000 was granted was given by Court.You query is silent on above aspect.I belive as a sunni muslim you have to return the mehar amount,and have to take care of her till iddat period.You have to prove that it's her mistake and that's why talak was Give to her then no maintainance wakt bord will take care of her maintenance.But however if ane move Court for Domestic Violence then in case of Muslims law is yet to be settled.Fell free to call it's a challenge to answer in so limited information.
