Question: Husband threatening to leave his high paying job if I dont give him second child. Does his behavior count as offence?

Ans: as per criminal law, the threatening itself is the offence. The problem you have stated is the mental harassment. So if you are ready to take action you can proceed by filing a complaint in any women police station.

This is one of the strangest questions I ever faced. Well. forcing you to have a second child when you are not willing to have is an offence. because a wife is not obliged even to have a first child ! I tell this on the basis of a judgement where it was held that one cannot divorce his wife for not bearing a child. But whether it is an offence to threaten his wife to quit his job ? No, because he is as free to do a job as he is free to quit it, it is his fundamental right, And even assuming it is an offence, how can you force him to work ? This cannot be brought before any Court.

Whether it is an offence or not, but it is ground for divorce if you so desires. But my sincere advise is to approach family counsellor and try to convince him, if he insists for second issue then it is for you to think deeper, there are chances of spoiling your entire future. Rest in person.
