05-Jul-2023 (In Family Law)
I want to need of married women rights in grand father property. Any law I heard before 1995 who did marriage her have not equal right in property is it real? Please guide me
Daughters have an equal share in the ancestral property irrespective of their date of marriage. However, according to the facts of your case your aunt does not have a share in the ancestral property as the Hindu Succession (Amendment) Act 2005 is prospective and not retrospective in nature. Her rights are governed by the unamended Section 6 of the Act, wherein the daughter had to take her share in the share of her deceased father.
