What are the Procedure involved under Section 498 A

20-Jul-2023 (In Family Law)
I have filed 498 A case one year ago but haven't received summon yet. whenever I have tried to get information from court they are misguiding me by stating that case is not started yet. After trying so hard I came to know that case had already started six months ago and dates are getting postponed. They haven't assigned me any lawyer neither they have informed me anything about the case. Could you please suggest me what is going wrong and what actions I should take?

Do you have FIR copy? (If not have obtain from concern police station )Against whom you lodged 498A ? Against Husband or along with his family members? You can contact the police Station for the progress of the case ? After lodging complaint they might have taken in him to Judicial Custody and he might have obtained bail. Then Police will investigate the matter and file charge sheet . Then court process will start. Every Police station assigned with PP (Public Prosecutor) he will look after the matter.

Dear Client,
You must verify from the court in which your case is pending. It is all procedure and judge must direct the police authorities to issue summons to you for giving evidence. Til then you must wait. You must consult additional public prosecutor of the concerned court in which your case is going on. Check thoroughly. Go to concerned court and verify.

You filed complaint with police, case registered U/s. 498-A IPC,. After completion of investigation the police will file chargesheet in court, whereupon a case will be taken on file by court. You being the complainant should get information of FIR No., etc, from the concerned police. Thereafter with that FIR No. you can enquire into court as to which new-number is given to your FIR,

You would be called by the court by issuing a summons, whenever needed. Its not your duty to visit court. The court will call only the perpetrator of crime. You need not worry. One fine day you will receive summons. You need not suspect that somebody is cheating you. Only you have to follow in right perspective,.
