23-May-2023 (In Family Law)
Husband left wife and filed fake rcr against wife, can wife contest and prove the allegations are false with evidences, if so can court dismiss the rcr filed by husband, what are the consequences if rcr gets dismissed ?
Hi,
Filing of false case with false pleading is wrong in the eye of law, but you have to prove that he is wrong and the wife is correct and she is willing to stay with the husband. If these point are being established before the court of law then rcr can be dismissed. For further assistance you can call through the website.

Hi
In general, if the husband has filed a RCR petition based on false allegations, the case will be dismissed.
The wife should approach the court and submit her defense and state that the husband has deserted her and filed a false case.
then the RCR case filed by the Husband will be dismissed and the wife can either file a divorce petition citing false case by husband or choose to live with the husband.

Hello,
Yes wife can contest the RCR case and prove the allegations as false with evidences. If you win the RCR case, RCR case will be dismissed. If the RCR case gets dismissed, your husband can prefer an appeal in the High court and can also file for divorce citing your desertion as the ground for divorce and try to end the relationship with you. If there are no chances of reunion between both of you, talk to your husband for Mutual Consent Divorce and end the marriage as there is no point in putting pressure on someone who doesn't wish to continue marital relationship.

Dear Client,
Wife can contest and prove the allegations are false with evidences. Court can dismiss the rcr filed by the husband if allegations are false. When rcr gets dismissed facts remain same in tact.
