What action can i take against my uncle for the fraud done by him

My father was cheated by his brother in a property. My owned a business in 1992 and all the earning where deposited by him to bank account and his brother was keeping check of it. He withdraw money and made few properties in his name. The big issue is with one property which is having 13 plots in one place. My dad and his brother purchased the property to build a big marriage hall my father's dream was to keep his father and mother's name for the hall. But at the time of registration he owned the property. Money to own this property was given by selling one of my dad's property also. Can I lodge a case now and claim the property. All earnings were my father's but he cheated sitting in the house ansd he also illegally cancelled my father's bank account so no evidence can be taken. But I have the passbook of the bank and all transactions. Is it possible to fight in court
