Son torturing me and claiming share in my property What can I do

Hello I have a question regarding mother she is 65above residing in her own flat, son has his own flat but resides with mother,nothg is provided food, medicine, etc daughter in law uses abusive language sometimes even goes to hit, son wants his share in mothers house or else he will not leave house, how can we vacate them,they torture her a lot. Plus urgent advice requested. Can we throw their thgs out and remove from house. Thanks(am from Muslim religion)

There is provision in law to maintain senior citizens by their son and relatives. You can get protection and maintenance order from court. As far as share in the property is concerned its her own will. If she doesn't want to give then she can take appropriate steps in law.

Firstly when you mother has her own flat, does she have ownership on her name? If yes then we can proceed.

You cannot make the son and the daughter vacate the house, unless you have the court orders to the effect. What the mother is going through is known as domestic violence in the legal language. The mother can file a DOMESTIC VIOLENCE petition in the magistrate court against the husband and the wife. Before that she needs to file a police compliant. Through the magistrate court she can file an injunction application restraining the husband-wife from entering the house.

First make will of your property and appoint care taker to look after her.
Give complaint in police station against him for physical and mental stress given by him.
If necessary give notice through lawyer for maintenance of your parent from her son.
Your mother can get monthly maintenance as of her right given by personal law.
