Schizophrenic woman's complaint against her husband
25-Apr-2023 (In Family Law)
My mother is schizophrenic. She fancies that my father has multiple affairs, blaming him everyday of it. He tolerates this false claim quietly almost everytime but rarely he raises his hands on her as today. Now she's going to lodge an FIR against him under Domestic Violence, mentioning also her delusions. Then she's going to take my custody (I'm 16), having claimed part of Father's wealth. But I know she can't raise me up alone. She manages to do the chores, but won't be able to handle other jobs well. Will her complaint be considered and she be given my custody, if her illness is revealed?
If your father can establish her mental illness then the police may not act on the basis of complaint of your mother. On this ground also her claim for custody can be nullified.
If you are unwilling to stay with your mother the court is bound to consider your wish.
