09-Jun-2023 (In Family Law)
In India suppose a muslim man gets a child out of a hindu woman and the woman is already married to a hindu man , what rights does the child and the mother have on the father , if the father is muslim and mother married hindu woman which law will apply, does islamic law comes into action which states that such a child is illegitimate and has no right on the father or will the case will be ruled by hindu law as the mother is hindu, what if the mother goes to court , in your opinion what will be the outcome of this case
Hi. In the narrow conspectus of facts narrated by you, it appears that illegitimate child will have no rights in the property of the muslim father but will have rights in the property of his mother inherited from muslim father. And in case of hindu father, the illegitimate son will have all the natural rights.
