Rights of daughters on fathers property if father died in 2003

we are 3 child of my father. one son and two daughters, two daughters are married in the year 2005 and 2010 respectively and i am married in 2007. my father was expired in the year 2003. i want to know about the rights of my married sisters in my father's properties.

It is better to respond from which religion you belong to give better answer to your query. If you belong to Hindu religion, you are entitled to the same share equivalent to your brother.

If you belong to Muslim religion, you are entitled to 1/2 share of your brother. If there is no brother, the all daughters would be entitled for equal share among them. But it is necessary that all the debts left by your father should be removed first, Maher of the wife of deceased should be removed, and then in the remaining the shares should be divided.

Dear Client,
Information is insufficient. What is the nature of the property. Whether it is self acquired property of your father or whether he inherited from you his fore fathers. If it is self acquired property, then you will get one forth share along with your two sisters and your mother if she is alive. If it is ancestral property you will get one share along with you sisters and deceased father as if he is alive, plus one fourth share of your father`s one fourth share along with your sisters and your mother. Simply to say you will get one forth share if it is your father`s self acquired property and if it is ancestral property you will get five by sixteen share.

if yo are hindu and your father died intestate i.e without executing any will,then all the children including male and female are having equal rights in the property of parents .Before filing any case for family partition,try t issue legal notice calling them to distribute shres.if they did not follow,you can file suit for family partition before t competent civil court.
