Renting flat to living relationship couple and society objection

27-Jun-2023 (In Family Law)
I rented out my flat and a couple who are in living relationship stays in that flat. Recently apartment society sent a notice saying living relationship couple cannot stay in the apartment on rent. Is there any law which will support the society to take such action? Do I have any option to oppose the society decision?

As per the supreme court judgement, living partners can reside in one house .No one can object their relationship. The notice issued by the society can be challenged in the court of law.You can send a reply notice quoting the recent supreme court judgment in regard to living partners and their rights.

Dear Client,
There is no such law till now. But recently Supreme Court ruled out giving rooms in Lodge for unmarried couple. You must read your society bye laws before opposing the option of the Society. If there is any bye law in the Society Bye laws prohibiting giving on rent to living relationship then you must stick onto that bye law, because you have signed on bye laws before you entering into society for membership. You must ask the Head of the Society about any law that ruled out giving on rent to the living relationship.

Hello,

There is no law that supports a society to ask live in partners to vacate the apartment and your flat by issuing you a notice to vacate them unless the partners are involved in illegal activities or activities against the terms and conditions of the society's bye laws, rules and regulations. If you can oppose the society's decision, you can send a reply to the notice issued by them and make your point. If they still oppose your decision, you can file a civil suit for mandatory injunction against them. Feel free to contact me if you need any further clarification.
